Terms of Service

1. Definitions

  • 1.1 "Platform" means the digital infrastructure operated by Euromed Konsult AB enabling submission of medical documentation and delivery of Expert Medical Reports.
  • 1.2 "Expert Medical Report" means a written advisory opinion prepared by an independent licensed physician.
  • 1.3 "User" means any individual, healthcare professional, or legal entity using the Platform.
  • 1.4 "Service" means the digital facilitation of access to a network of independent medical experts and the delivery of Expert Medical Reports, provided as an Information Society Service under EU Directive 2000/31/EC.
  • 1.5 "Advisory Facilitation" means Euromed's role as an intermediary platform provider that connects Users with Independent Consulting Experts, without assuming clinical responsibility for the medical content of Expert Medical Reports.
  • 1.6 "Independent Consulting Expert" means a licensed physician operating under their own professional license and insurance, who provides advisory opinions in their own name through the Platform.

2. Legal Nature of the Service

  • 2.1 Euromed Konsult AB provides a digital advisory facilitation service and access to a federated network of independent medical experts, classified as an Information Society Service under EU Directive 2000/31/EC. Euromed's role is limited to operating the Platform, coordinating administrative processes, and facilitating the connection between Users and Independent Consulting Experts.
  • 2.2 Not Healthcare — The Company is not a healthcare provider and does not provide diagnosis, treatment, or prescriptions.
  • 2.3 No Doctor-Patient Relationship — Use of the Platform does not establish a doctor-patient relationship between the User and the Company or consulting experts.
  • 2.4 Country of Origin — The User acknowledges that Independent Consulting Experts are licensed physicians within the EU/EEA. The medical advisory opinion is deemed to be provided from the Expert's country of professional establishment. Euromed's platform services are provided from Sweden under the Country of Origin principle of the E-Commerce Directive (2000/31/EC).
  • 2.5 Expert-to-User Relationship — The legal relationship regarding the medical content of an Expert Medical Report is established directly between the User and the Independent Consulting Expert who authored the report. Euromed acts solely as the intermediary platform provider and assumes no clinical responsibility for the medical content of advisory opinions.

3. Eligibility and User Responsibilities

Users must be at least 18 years old and capable of entering into binding legal agreements. Users are responsible for providing accurate medical information and maintaining confidentiality of Platform credentials.

4. Emergency Disclaimer

Expert Medical Reports are not emergency medical services. In case of a medical emergency, Users must contact emergency services immediately.

5. Expert Medical Reports

  • 5.1 Advisory Nature — Expert Medical Reports are informational and advisory only.
  • 5.2 Local Physician Responsibility — All clinical decisions must be made by the User's treating physician following a physical examination.
  • 5.3 Expert Identification — Each Expert Medical Report shall identify the Independent Consulting Expert by name, country of establishment, and applicable professional regulatory framework. The Expert provides the advisory opinion in their own professional capacity.

6. Payment and Fees

All fees are stated in the service order. Payment must be made in full before the Expert Medical Report is delivered.

7. Intellectual Property

Expert Medical Reports may be used by the User for personal healthcare decision-making. All other intellectual property rights remain with Euromed and the respective Experts.

8. Confidentiality

Euromed maintains confidentiality of User medical information in accordance with applicable data protection laws.

9. Indemnification

Users indemnify Euromed from any claims arising from misuse of Expert Medical Reports or violation of these Terms.

10. Term and Termination

This agreement begins when the User creates an account and continues until terminated by either party with written notice.

11. Limitation of Liability

  • 11.1 Medical Disclaimer — Euromed is not responsible for any medical consequences arising from the use or misuse of Expert Medical Reports.
  • 11.2 Liability Cap — To the maximum extent permitted by law, Euromed's total liability for any claim shall not exceed the amount paid by the User for the relevant Expert Medical Report.
  • 11.3 Force Majeure — Euromed is not liable for failures due to circumstances beyond its reasonable control.
  • 11.4 Platform vs. Clinical Liability — Euromed's liability is limited to the performance of the Platform and its administrative facilitation services. Euromed is not liable for the medical content, clinical accuracy, or professional judgment contained in Expert Medical Reports, which remain the sole professional responsibility of the Independent Consulting Expert.

12. Governing Law

These Terms are governed by Swedish law and the laws of the European Union.

13. Dispute Resolution

Disputes shall be resolved through arbitration in accordance with the Swedish Arbitration Act.

14. Amendments

Euromed may amend these Terms with 30 days' written notice to Users.

15. Informed Consent

By using the Platform, Users confirm their understanding that:

  • (a) the advisory facilitation service connects the User with Independent Consulting Experts through a digital platform, and does not constitute direct healthcare provision by Euromed;
  • (b) Expert Medical Reports are advisory only and do not replace the User's treating physician;
  • (c) medical decisions must be made by a qualified local physician;
  • (d) in emergencies, contact emergency services immediately.

16. Consumer Protection Rights

If the User is a consumer, the User may benefit from mandatory consumer protection laws in their country of residence that cannot be waived by these Terms.

17. Right of Withdrawal

Consumers have the right to withdraw from the purchase within 14 days of ordering, unless the Expert Medical Report has been delivered.

18. Complaints Procedure

Users may lodge complaints by contacting Euromed within 30 days of the service delivery. Euromed will respond within 15 business days.

19. Alternative Dispute Resolution

Disputes with consumers may be referred to an accredited alternative dispute resolution (ADR) provider in the User's country.

20. Out-of-Court Settlement

Users may pursue out-of-court settlement mechanisms before initiating formal dispute resolution procedures.

21. ISS Classification and Platform Model

  • 21.1 Euromed Konsult AB operates as an Information Society Service provider within the meaning of EU Directive 2000/31/EC and Directive (EU) 2015/1535. The Platform is a digital intermediary that facilitates access to a federated network of independent medical professionals.
  • 21.2 Euromed does not: (a) employ or supervise the clinical judgment of Independent Consulting Experts; (b) provide medical diagnosis, treatment, or prescriptions; (c) assume clinical responsibility for the content of Expert Medical Reports; (d) establish a doctor-patient relationship between any party.
  • 21.3 The Independent Consulting Expert bears sole professional responsibility for the medical content of their advisory opinions, subject to the professional regulatory framework of their country of establishment.
